COMPETITION RULES for TreeSurvey APRIL – MAY PROMOTIONAL COMPETITION RULES 2019

1. This Promotional Competition (“Competition”) is organized by Heuristic Guru (Proprietary) Limited and its agencies (“Promoter”).

2. The Competition is open to permanent residents and citizens of South Africa over the age of 18 (eighteen) years.

3. The Competition is only valid within South Africa. Participants must be within South Africa at the time of entering the Competition, for the verification process and at the time of the prizes being awarded should they be declared a Winner, failing which such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the first draw.

4. By entering the Competition, all Participants and Winners agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding and no correspondence shall be entered into regarding the decision. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.

5. The Competition commences on 10 April 2019 and ends 31 May 2019 both days inclusive.

6. The prizes (“Prizes”) includes the following:

a. 1 hour Arborist consultation fulfilled by Arbor Care Tree Specialists in Gauteng accompanied by shot hole borer control and treatment service (maximum of 100cm DBH) deemed suitable by Arbor Care Tree Specialists for the infested tree/s. (referred to as “PSHB Consultation Gauteng”);

b. 1 hour Arborist consultation fulfilled by Tree Works in Johannesburg accompanied by shot hole borer control and treatment service (maximum of 100cm DBH) deemed suitable by Tree Works for the infested tree/s. (referred to as “PSHB Consultation Joburg”);

c. 1 hour Arborist consultation fulfilled by Riaan Van Zyl in Cape Town accompanied by shot hole borer control service (maximum of 100cm DBH) deemed suitable by Riaan Van Zyl for the infested tree/s. (referred to as “PSHB Consultation Cape Town”);

d. 1 hour Arborist consultation fulfilled by Leitch Landscapes in Durban. (referred to as “PSHB Consultation Durban”);

e. 1 hour Arborist consultation fulfilled by Reitz Tree Care in the Garden Route accompanied by shot hole borer control service (maximum of 100cm DBH) deemed suitable by Reitz Tree Care for the infested tree/s. (referred to as “PSHB Consultation Garden Route”);

f. 1 day attendance at the Johannesburg PSHB Workshop. (referred to as “PSHB Workshop”);

g. 1 hamper containing the PSHB “What To Do Guide”, PSHB Control Training Material, and PSHB Control Protocol. (referred to as “PSHB War Chest”);

7. To stand a chance of winning any of the Prizes listed in clause 6a & 6b & 6c & 6d & 6e & 6f & 6g Participants must use the Tree Survey mobile app and submit two separate incidents, one incident reporting a private tree, and one incident reporting a public tree (“Participating Service”);

a. Download the mobile app

b. Log an incidents and submit at least one photo of a PSHB infested private tree

c. Log an incidents and submit at least one photo of a PSHB infested public

d. Retain the two Tree Survey incidents on your mobile phone as proof of servicde – (hereinafter referred to as an “Entry”). One entry per registered Tree Survey mobile application user.

9. All Prize Winners will be determined by random automatic selection draw on the following draw dates: The Prizes draw will take place on the by no later than the 15th of June 2019.

10. Participants may report as many incidents as they wish over the Competition period, however one one entry into the competion as provider to each registered Tree survey Mobile App user as set out in Rule 7 above.

11. PSHB CONSULTATION PRIZES

a. The Promoter will call the possible finalists on the cellphone number used to enter the Competition. The possible finalist will be called once a day for 3 (three) days and if the Promoter is not able to contact the possible finalist during this time, the Promoter will move onto the next possible Winner.

b. The Service will be provided in the specified region, as such the qualifying entried for each prize will be determined by the geolocation of the incidents being contined within the city that the prize is specified.

c. The Consultation Prizes cannot be exchanged for any other services, and cannot be converted to a cash value.

d. The promoter reserves the right to change the service offering , if the service is no longer available.

e. No liability shall attach to the Promoter in relation to any claims, losses or liabilities for any loss of profit or any other direct and/or indirect, special or consequential loss arising out of any of the Prizes. The Promoter is not liable for any defects in the Prizes. Ownership of and risk in, and benefit attaching to, the Prizes will pass to the Winner immediately.

f. All Prizes are awarded at the discretion of the Promoter. The Promoter reserves the right, at its own discretion, to substitute a Prize with any other Prize of comparable commercial value or an appropriate replacement value in the place of the Prize.

12. The Prizes are neither transferable nor redeemable for cash and the Promoter is not liable for any defect in the Prize.

13. In addition to any other the verification requirements set out in these Rules, the Promoter may require the Prize Winners to complete and submit an information disclosure agreement and indemnification, as well as supply a certified copy of their valid South African ID or Passport with their endorsed residence permit within 24 (twenty four) hours of being confirmed a Winner, to enable the Promoter to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any Winner refuse or be unable to comply with this rule for any reason, such Winner will be deemed to have rejected the Prizes and it shall revert back to the Promoter.

14. No liability shall attach to the Promoter in relation to any claims, losses or liabilities for any loss of profit or any other direct and/or indirect, special or consequential loss arising out of any of the Prizes. The Promoter is not liable for any defects in the Prizes. Ownership of and risk in, and benefit attaching to, the Prizes will pass to the Winner immediately upon delivery.

15. In addition to any other the verification requirements set out in these Rules, the Promoter may require the Prize Winners to complete and submit an information disclosure agreement and indemnification, as well as supply a copy of their valid South African ID or valid Passport with the endorsed residence permit within 24 (twenty four) hours of being confirmed a Winner, to enable the Promoter to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any Winner refuse or be unable to comply with this rule for any reason, such Winner will be deemed to have rejected the Prizes and it shall revert back to the Promoter.

16. The Promoter may require the Winners to be identified and photographed and the photographs published in printed media. The Winners will be given the opportunity to decline to the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Competition.

17. All Participants and the Winners, as the case may be, indemnify the Promoter, their advertising agencies, advisers, nominated agents, suppliers and identified by the trademarks owned by or licensed to Heuristic Guru (Propriety) Limited, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way in this Competition including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or use of the Prizes.

18. All entrants that engage with the promotion information will not be shared with any third parties and are strictly kept with the Promoter. All Entrants will receive future communication from the Promoter and if the Entrant no longer wants to receive communication they can choose to Opt-out of the SMS and any other communication channels.

19. The Promoter reserves the right to cancel, terminate or suspend the competition and select Winners from the among all eligible entries received prior to the cancel.

20. By entering the competition all Participants agree to be bound by the rules, regulations and requirements set out in the promotional material. This competition is subject to South African law, and is not offered outside South Africa.
